01. Nature of Our Services

ESM Markets provides educational information relating to financial markets, including trading systems, market commentary, execution plans, trade recaps, and private development.

Our services are provided for educational and informational purposes. They are not intended as personalized investment advice or recommendations based on your individual financial circumstances.

References to specific market levels, entries, exits, targets, or trading opportunities do not guarantee that any trade will be profitable.

02. Trading Risks

Futures trading and other forms of leveraged trading involve substantial financial risk.

You may lose your entire trading capital and, in certain circumstances, incur losses exceeding your initial investment.

Past performance is not necessarily indicative of future results.

ESM Markets does not assume responsibility for losses resulting from your independent trading decisions, to the extent permitted by applicable law.

03. Daily Trading Group

Our Daily Trading Group provides access to educational resources and information about the execution of our trading system.

Membership features may include:

• Daily ES/MES trading plans detailing entries, exits, and targets.
• Ongoing updates regarding triggered entries, completed targets, and changing market conditions.
• Detailed trade recaps explaining executions and their reasoning.
• Additional educational resources and system reference materials.

Membership does not guarantee a specific number of trading opportunities, successful trades, or profitable outcomes.

Content availability may vary depending on market conditions, scheduled trading activity, and operational circumstances.

04. Membership Pricing

ESM Markets may offer monthly, multi-month, annual, and introductory membership options.

Prices and promotions may change. The price, billing frequency, and renewal terms displayed at checkout govern your purchase.

Special membership pricing may be available to eligible private development participants under the terms of their individual offer.

05. Automatic Renewals

When you purchase a recurring membership, you authorize the applicable payment provider to charge your selected payment method according to the billing schedule disclosed at checkout.

For the introductory monthly membership, the initial charge is $47 for 30 days. Unless canceled before renewal, the membership subsequently renews at $197 per month.

Three-month and annual memberships renew only if the selected checkout plan is configured as a recurring subscription.

Applicable taxes or other charges, if any, will be disclosed at checkout.

06. Subscription Cancellation

You may cancel a recurring membership through the membership platform's available account or billing controls.

Cancellation stops future recurring charges once successfully processed, subject to the applicable billing deadline and any mandatory legal requirements.

Unless otherwise specified at checkout, access continues through the end of the current paid membership period.

07. No Refunds Policy

This policy applies to introductory membership payments, monthly subscriptions, three-month and annual memberships, private development programs, and other digital educational services.

Customers are responsible for reviewing the service description, pricing, billing terms, and suitability of the purchased service before completing payment.

Due to the digital nature of our educational materials and membership access, purchasing a service may provide immediate access to proprietary information and resources.

Dissatisfaction with trading results, failure to achieve profitability, lack of usage, or changes in personal circumstances do not independently establish eligibility for a refund.

Canceling a subscription prevents future renewals once the cancellation is effective, but does not automatically reverse charges already incurred.

If you believe a charge was unauthorized, incorrect, or subject to a legal or contractual refund right, contact us at 1esmorg@tdbdtrading.com so we can review the matter.

Nothing in this policy limits consumer rights, payment dispute rights, or remedies that cannot legally be waived.

08. Private 1-on-1 Development

Private development is a separate educational service intended to help participating traders learn and properly implement our trading system.

Depending on the offer purchased, services may include an initial private Zoom session, follow-up guidance, and temporary access to the Daily Trading Group.

Specific deliverables, pricing, scheduling arrangements, and eligibility requirements are governed by the offer presented at enrollment.

Participation does not guarantee profitability, a particular win rate, or any specific financial outcome, except to the extent an express written offer provides a specific contractual remedy.

09. Capital Scaling Opportunities

Certain private development participants may become eligible to discuss separate opportunities involving the scaling of trading accounts or capital.

Such opportunities are not automatically included with any membership or private development purchase.

Any arrangement of this nature requires separate review, approval, and a written agreement.

No future funding, allocation, or participation is guaranteed.

10. Intellectual Property

Original educational materials, system documentation, videos, written content, graphics, and other proprietary resources provided by ESM Markets are protected by applicable intellectual property laws.

Purchasing access grants you a limited, personal, non-transferable right to use the materials for their intended purpose.

You may not reproduce, redistribute, resell, publicly publish, or commercially exploit protected materials without prior written authorization.

11. Account Access and Conduct

Membership access is intended for the individual purchaser unless expressly stated otherwise.

Unauthorized account sharing, redistribution of paid content, fraudulent activity, harassment, or misuse of our services is prohibited.

Violations may result in restricted or terminated access, subject to applicable law and any contractual refund rights.

12. Service Availability

We aim to provide reliable access to our educational services and membership resources.

However, availability may be affected by platform outages, scheduled maintenance, market conditions, technical difficulties, or other circumstances beyond our control.

We do not guarantee uninterrupted access to every service or feature.

13. Limitation of Liability

To the maximum extent permitted by applicable law, ESM Markets and its operators are not liable for trading losses arising from customers' independent trading decisions.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

14. Changes to Services and Terms

We may update these Terms or modify our services periodically.

Material changes affecting existing subscriptions will be communicated as required by applicable law and contractual obligations.

15. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, subject to applicable consumer protection laws and mandatory legal requirements.
